1. Introduction

Welcome to the Hola Finance App ("the App"), provided by the Hola Group, a trading name of Default Settings SC (J75489104) in Spain. Our registered office is located at Calle Soto 5, Vélez-Rubio, 04820, España. By accessing or using the App, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not use the App.

2. Overview of the Service

The Hola Finance App is an invoice and expense management platform designed to help users organise and manage their financial records. While we strive to provide accurate and reliable functionality, we take no responsibility for errors, including but not limited to incorrect calculations, data processing issues, or user input errors.

3. Data Storage and Processing

  • 3.1 Location of Data Storage
    All user data, including invoices, expenses, and associated information, is securely stored within the European Union (EU) in compliance with applicable data protection laws. Our primary storage and processing servers are provided by Hetzner, utilising their facilities in the EU, and Scaleway for S3 storage solutions.
  • 3.2 Public Data Storage
    Logos and other publicly accessible files are stored on Hetzner and Scaleway S3 servers and are accessible as public assets.
  • 3.3 Private Data Storage
    Invoices, expenses, and other sensitive user data are stored privately on Hetzner and Scaleway S3 servers. Access to this data is restricted and protected using industry-standard security practices.
  • 3.4 Data Backups
    All user data is regularly backed up to secure offsite storage using Backblaze B2 to ensure data recoverability in the event of an incident.
  • 3.5 Data Processing Partners
    We use the following third-party services to process data:
    • OpenAI and Anthropic AI: For expense analysis and other data processing.
    • Postmark (postmarkapp.com): For email processing services.
    • Cloudflare: As a proxy and to provide additional network security.
  • 3.6 Right to Change Processing Partners
    We reserve the right to change or add data processing partners at any time. Updates to these Terms will reflect such changes. It is the user’s responsibility to review the latest version of the Terms, as no notifications will be provided.
  • 3.7 Data Security
    We employ best efforts to secure your data using encryption, access controls, and monitoring. However, no system is completely immune to breaches. By using the App, you acknowledge that your data may be at risk due to unforeseen circumstances beyond our control.
  • 3.8 Data Retention
    We retain your data indefinitely or until you request its deletion. If you wish to have your data removed, please contact us using the details provided in Section 17.
  • 3.9 Access by Team Members
    Your invoice, expense, and associated data may be accessed by our team, but only on an as-needed basis to ensure the proper functioning of the App and related services.
  • 3.10 Anonymous Aggregated Data
    We may aggregate and anonymise your data to create statistics such as total invoice value, total expenses, and user counts. These statistics will not identify individual users.

4. User Responsibilities

  • 4.1 Accuracy of Data
    You are solely responsible for ensuring that the data you upload, input, or generate through the App is accurate and complete. This includes, but is not limited to, invoice details, expense entries, and financial records.
  • 4.2 Compliance with Laws
    You agree to use the App in compliance with all applicable laws, regulations, and industry standards. The App does not guarantee compliance with tax laws, financial reporting standards, or other regulatory requirements. It is your responsibility to ensure compliance.
  • 4.3 Review of Terms
    You are responsible for reviewing these Terms periodically. Changes to these Terms will be posted on the App, and no notification will be provided. Continued use of the App constitutes your acceptance of the updated Terms.
  • 4.4 Future Changes Acceptance
    By using the App, you agree to accept any future changes to these Terms and Conditions as they are updated.
  • 4.5 Age Requirement
    The App is intended for use by individuals aged 16 years and older. By using the App, you confirm that you meet this age requirement.
  • 4.6 Global Accessibility
    The App is accessible to users worldwide. By registering for the App, you confirm that its use complies with the laws of your country.

5. Authentication and Passwords

  • 5.1 Secure Passwords
    All user passwords are securely hashed and cannot be accessed by us. You are responsible for keeping your login credentials secure and confidential.
  • 5.2 Third-Party Authentication
    You may log in to the App using third-party authentication providers, including Apple, Facebook, Google, and LinkedIn. By using these providers, you agree to their respective terms and conditions and privacy policies.

6. Service Availability and Reliability

  • 6.1 Best Efforts
    We strive to maintain the availability and reliability of the App. However, we make no guarantees regarding uptime, functionality, or uninterrupted access.
  • 6.2 Service Interruptions
    The App may experience downtime, technical issues, or become permanently unavailable without prior notice. You agree that we are not liable for any loss, inconvenience, or damages resulting from such interruptions.
  • 6.3 No Warranty
    The App is provided "as-is" and "as-available" without any warranty, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • 6.4 No Liability for External Breaches
    We cannot be held liable for any loss of data or security breaches caused by circumstances beyond our control, including but not limited to attacks on third-party providers, natural disasters, or unforeseen technical failures.

7. Limitation of Liability

  • 7.1 Exclusion of Liability
    To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the App, including but not limited to:
    • Financial losses resulting from incorrect calculations or data inaccuracies.
    • Breaches of security or unauthorised access to your data.
    • Service interruptions, downtime, or permanent discontinuation of the App.
  • 7.2 User Responsibility
    You assume full responsibility for the use of the App and any actions or decisions made based on its output or functionality.
  • 7.3 Calculation and Prediction Disclaimer:
    Any calculations, predictions, or analyses provided by the App are for informational purposes only. We do not guarantee their accuracy, reliability, or applicability to your specific situation. You acknowledge that you are solely responsible for verifying any outputs from the App before relying on them.

8. Employee Indemnification

You agree to indemnify, defend, and hold harmless the Hola Group, its employees, officers, directors, and affiliates from any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

9. Data Ownership and Transfer

  • 9.1 User Data Ownership
    You retain ownership of the data you upload to the App. By using the App, you grant us a non-exclusive, royalty-free license to process, store, and display your data as necessary to provide the App’s services.
  • 9.2 Data Transfer
    We reserve the right to transfer ownership of the App, its assets, and all associated user data to another company or entity at any time. If such a transfer occurs, the new owner will be bound by these Terms or an equivalent set of terms. You will be notified of any material changes resulting from the transfer.

10. Intellectual Property

  • 10.1 App Content
    All intellectual property related to the App, including but not limited to code, designs, logos, and documentation, is owned by the Hola Group or its licensors. Unauthorised use of this intellectual property is prohibited.
  • 10.2 User Content
    By uploading content to the App, you confirm that you have the right to use and share this content and that it does not infringe on the rights of any third party.

11. Termination of Service

We may suspend or terminate your access to the App at any time for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the App will cease immediately.

12. Changes to Terms and Conditions

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the App. Continued use of the App after changes have been posted constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

  • 13.1 Governing Law
    These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union.
  • 13.2 Dispute Resolution
    Any disputes arising out of or in connection with these Terms shall be resolved through negotiation or, if necessary, in the courts of the relevant jurisdiction in Spain.

14. Third-Party Links and Services

The App may include links to third-party websites or services. We are not responsible for the content, policies, or practices of these third-party websites or services. Your use of these third-party services is at your own risk.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Hola Group, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
